LEGAL AND/OR TECHNICAL ADVICE POLICY
1. PURPOSE
This policy contains the Board’s decision that it does not provide external legal and/or technical advice.
This policy has been approved by the Board.
This policy applies to all Board members and employees working for the Board (both Board appointed employees and public servants). It also applies to other persons who perform work for the Board including contractors, students gaining work experience and volunteers.
This policy applies to Board members and employees in all of their work-related dealings with external parties.
2. POLICY STATEMENT
On occasion, the Board is requested by various individuals and entities to provide legal and/or technical advice. Requests typically seek advice on the application of the Professional Engineers Act 2002 (Act) to an individual’s or an entity’s specific circumstance.
The key functions of the Board are:
- to register professional engineers as RPEQs (Registered Professional Engineers of Queensland)
- to conduct, or authorise, investigations about the professional conduct of RPEQs and contraventions of the Act
- to keep a register of RPEQs.
None of the Board’s members or staff are authorised to provide technical and/or legal advice to external parties.
Although the Board may employ or engage legal practitioners, RPEQs or other technical staff from time to time, the purpose of their engagement is to advise the Board. It is not their function to provide legal or technical advice, either specific or general, to external parties.
External parties are encouraged to consider seeking their own independent legal and/or technical advice.
3. RESPONSIBILITIES
The Board and its staff may choose to direct general enquiries to relevant resources or parts of the Act considered relevant. However, they will not provide legal or technical advice externally.
